1. About the service

Trakr Site Plan Creator is a free online tool that allows users to create illustrative site plans, drawings, and annotations on an interactive map. The service is provided by Trakr ("we", "us", "our").

By using the service, you agree to these terms. If you do not agree, do not use the service.

2. Nature of the tool

The service provides tools for creating illustrative site plans and drawings. It is designed for visualisation and communication purposes only.

3. No legal boundary guarantee

Plans generated through the service are not official title plans, legal boundary plans, or survey documents. They do not constitute legal evidence of property boundaries.

4. No professional reliance

You must not rely on outputs from the service for:

Land or property disputes
Conveyancing or property transactions
Construction setting out or engineering
Legal matters of any kind
Professional surveying or measurement

Always consult a qualified professional (e.g., chartered surveyor, solicitor) for any decision based on property information.

5. Measurements are approximate

All measurements (area, distance) calculated by the service are approximate and derived from OpenStreetMap data. They are not survey-grade and should not be treated as accurate for legal or construction purposes.

6. User content

You retain ownership of all drawings, annotations, and other content you create using the service ("User Content"). By using the service, you grant us permission to:

Store your User Content to provide the service
Process your User Content as necessary to render and export your plans
Display your User Content to you within the service

We do not claim ownership of your User Content. We will not use it for purposes other than providing the service to you without your explicit consent.

7. Acceptable use

You agree not to:

Use the service for any illegal purpose
Scrape, crawl, or systematically extract data from the service
Attempt to overload, disrupt, or damage the service
Submit harmful content (malware, viruses, etc.)
Use the service to harass, threaten, or harm others
Misrepresent the outputs of the service as professional surveys or legal documents

8. Intellectual property

All intellectual property rights in the service, excluding third-party content, belong to Trakr. This includes the software, design, brand, and any templates or presets provided within the service.

You may not copy, modify, reverse-engineer, or redistribute the service or its components without our written permission.

9. Third-party data

The service uses map data from OpenStreetMap (ODbL licence) and OpenFreeMap. Satellite imagery is provided by Esri and its licensors. See our Attribution page for full credits.

Satellite imagery is for interactive viewing only and is excluded from PDF/PNG exports due to licensing restrictions.

10. Disclaimer of warranties

The service is provided "as is" without any warranty, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or meet your requirements.

11. Limitation of liability

To the fullest extent permitted by law, Trakr shall not be liable for any damages arising from your use of the service, including but not limited to reliance on measurements, drawings, or exported plans.

12. Termination

We reserve the right to suspend or terminate access to the service at any time, without notice, for breach of these terms or for any other reason.

13. Changes to these terms

We may update these terms. Continued use of the service after changes take effect constitutes acceptance of the updated terms.

14. Governing law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
